COMPREHENSIVE IMMIGRATION REDUCTION
The Associated Press reports, "that grants automatic citizenship to babies born in the United States." This is not true. There is no organization, no government entity that grants citizenship. The 14th Amendment says that the person had to be under the "jurisdiction of" the United States. Former slaves were under the jurisdiction of the United States, but foreign diplomats and Native Americans were not because they were considered citizens of their own Tribes, with which the U.S. go vernment had treaties. That is, Native Americans were citizens of another nation, not the United States. This was later changed by law.
Today, an anchor born of illegal parents is not granted citizenship, but will be supplied the necessary de facto citizenship of a driver's license and U.S. passport, because the only evidence that is needed is birth certificate stating he/she was born in the United States. Because this is fraudlent, the parents were never under the jurisdiction of the United States, anchor baby citizens are equally fradulent. The lack of enforcement and improper registration does not constituting granting anchor babies citizenship.
When a baby is born in the United States, it is not registered as a citizen, although it is given a social security number, but it is given a birth certificate stating that the child was born in a particular place in the United States.
If former decades, when there was not the massive immigration and illegal immigration into the country, the birth certificate was the key document. It was the document that allowed a person when applying for a driver's license it allowed state to determine that the person was in fact born in the United States and identified the person. It was not a matter of citizenship. The problem of illegal entry did not exist.
Equally, when applying for a passport, the State Department requires the person provide a birth certificate that states the person was born in the United States. It assumes that the person is hence a citizen. This is where an anchor-baby-citizen is in effect granted citizenship, but again this fraudulent.
Presumably, if a French diplomat had a child, and the child came back 18 years later to apply for a passport and a driver's license, the child would get one. The framers of the 14th Amendment never were agreeing to this.
The problem of citizenship must be dealt with at two levels. At the State Level, the agencies and hospitals must have two types of birth certificates, 1) for illegals that clearly states the child is not born of at least one U.S. citizen and 2) one for American citizens that clearly states the child is born of of at least one U.S.. Supporting information should be kept on file and therefore available for any later challenges.
The State Department, likewise, should not issue passports to anyone who cannot prove their parents were U.S. citizens. A birth certificate only stating that the person was born in the United States should not be sufficient proof. The United States is one of the few countries that assumes that all persons born within the country are citizens.
If there were 340,000 anchor babies born last year, 2010, then in 2028 they will become defacto citizens. The same is true of Tourist Babies whose mothers come into the United States, give birth and go home. 18 years later, as an adult, the person can come back to the United States and register for a driver's license, vote and get a passport.
The laws must be changed to reflect the new reality. As expected, the Federal Government will not act, but states can register births demanding proof of citizenship of their parents and issue two types of birth certificates. That would be a start.
Also, strong enforcement of employment laws would cause many families to go back to their home countries, bringing their anchor babies with them.
